Comfort Workshop Terms and Conditions of Sale
These Terms and Conditions apply to all orders placed with Comfort Workshop for riser recliner chairs, specialist seating, accessories, replacement cushions, fabrics, parts and related services.
Please read these Terms carefully before placing an order. By placing an order with us, you agree to be bound by these Terms.
1. About us

In these Terms, “we”, “us” and “our” mean Comfort Workshop and/or David Carter Design. “You” and “your” mean the customer placing an order.
2. Our products and services
We design, manufacture and supply riser recliner chairs, made-to-fit seating, specialist seating, accessories and related products.
Many of our chairs are made to order, made to measure, individually specified, or adapted to suit a customer’s chosen size, fabric, mechanism, back style, accessories or personal requirements. These products are treated as bespoke or personalised goods.
We may also occasionally supply non-bespoke stock products. Where a product is non-bespoke, this will be confirmed clearly on your order paperwork.
3. Home consultations and showroom appointments
We may offer home consultations or showroom appointments to help you choose a suitable chair. During a consultation, we may discuss your height, size, posture, mobility, room layout, chair use, fabric preference and other practical requirements.
Our advice is given to help you choose a suitable product, but you remain responsible for checking that the order details are correct before confirming your order.
Unless we specifically agree otherwise in writing, our advice should not be treated as medical advice, clinical diagnosis, occupational therapy advice, or a substitute for professional healthcare advice. If you have complex medical, postural or pressure-care needs, you should seek advice from a suitably qualified healthcare professional before placing an order.
4. Order details and customer responsibility
Before placing an order, we will confirm the main details of your chosen product, which may include the model, size, fabric, colour, mechanism, back type, seat cushions, accessories, delivery details and any special requirements.
It is your responsibility to make sure the details on the order are correct before signing or confirming the order.
You must tell us about anything that may affect delivery, installation or use of the product, including narrow doorways, stairs, steps, parking restrictions, limited access, unusual flooring, tight corners, low ceilings, first-floor flats, lifts, or any other access restrictions.
You are also responsible for checking that the chair will fit in the intended room and that there is sufficient space for the chair to operate safely, including when reclining, rising or moving.
If we are unable to complete delivery because of access restrictions, incorrect information, nobody being available, or the product not fitting into the property, we may charge you for reasonable redelivery, storage, labour or transport costs.
5. Prices and quotations
All prices will be confirmed before you place your order.
Unless stated otherwise, prices include VAT. Where VAT relief applies, the price may be zero-rated for VAT, provided that the correct VAT eligibility declaration is completed.
Quotations are valid for 30 days unless stated otherwise.
We reserve the right to correct any obvious pricing error before accepting an order.
6. VAT relief
Some products may be eligible for VAT relief where they are purchased by, or for, a person who is chronically sick or disabled and the product is designed or adapted for their personal or domestic use.
To receive VAT relief, you must complete and sign a VAT eligibility declaration. You are responsible for ensuring that the declaration is accurate.
If you are unsure whether you qualify for VAT relief, you should seek advice from HMRC or a suitable tax adviser before signing the declaration.
If VAT relief is later found not to apply because of inaccurate or incomplete information provided by you, we reserve the right to charge the VAT that would have been payable.
7. Payment
To place an order for a made-to-order, made-to-measure or bespoke product, we normally require a deposit of 30%.
The remaining balance becomes due when we confirm your delivery date, and must be paid in full before delivery, unless we agree otherwise in writing.
For stock products, accessories, replacement parts, urgent orders or products delivered on the same day, we may require full payment at the time of order.
We accept payment by bank transfer, debit card, credit card and cash, unless we agree another method in writing.
Goods remain the property of Comfort Workshop / David Carter Design until we have received payment in full.
8. Bespoke and made-to-order products
A product will normally be classed as bespoke, personalised or made to order if it is manufactured, adapted or ordered specifically for you. This may include products where you choose the size, fabric, colour, mechanism, back style, cushion type, accessories, or any special requirements.
Once we have accepted your order and started work, ordered materials, allocated production time, or committed to your bespoke product, you will not usually have the right to cancel the order unless the product is faulty, damaged, incorrectly supplied, or we agree cancellation at our discretion.
Where we do agree to cancel a bespoke order, we may deduct reasonable costs already incurred, including fabric, components, labour, administration, design work, transport, and any other costs connected with the order.
9. Non-bespoke stock products and cancellation rights
If your order is for a non-bespoke stock product, you may have a legal right to cancel within 14 days of receiving the goods.
To cancel, you must notify us clearly in writing by email or post within 14 days of delivery.
The goods must be returned complete, undamaged, unused beyond reasonable inspection, and with all labels, manuals, accessories and original packaging where reasonably possible.
You are responsible for the cost of returning the goods unless the product is faulty, damaged or incorrectly supplied.
If we arrange collection, we may charge a reasonable collection fee, unless the product is faulty, damaged or incorrectly supplied.
We may make a deduction from any refund if the value of the goods has been reduced because they have been handled, used, marked, damaged, installed, exposed to smoke, pet hair, odours, soiling, bodily fluids, infection risk, or handled beyond what would reasonably be allowed in a showroom.
Refunds will be made using the original payment method unless agreed otherwise.
10. Changes to orders
If you wish to change your order, you must contact us as soon as possible.
We will try to accommodate reasonable changes, but this may not always be possible once production has started, materials have been ordered, or the product has been completed.
Any agreed changes may affect the price, specification, delivery date or lead time.
Changes are only binding once confirmed by us in writing.
11. Product appearance, fabrics and handmade variation
Product images, samples, brochures, website photos and showroom models are for guidance only.
Colours, textures, finishes and fabric appearance may vary slightly depending on lighting, screen settings, fabric batch, natural variation, and manufacturing processes.
As many of our products are handmade or individually finished, small variations in dimensions, stitching, padding, fabric tension, cushion feel and appearance may occur. These will not be treated as faults unless they materially affect the quality, safety or intended use of the product.
Foams, cushions and fabrics may soften or settle with normal use.
12. Delivery and installation
We will contact you to confirm a delivery date once your product is ready. The remaining balance becomes due when that delivery date is confirmed and must be paid in full before delivery, unless we agree otherwise in writing.
Any delivery dates or lead times are estimates unless we specifically agree in writing that time is of the essence.
You must ensure that someone is available at the agreed delivery address to accept delivery.
You must provide safe and reasonable access for our delivery team. This includes suitable parking, clear walkways, sufficient space, and removal of obstacles where necessary.
If delivery cannot be completed because of access problems, incorrect information, nobody being available, or refusal of delivery, we may charge reasonable costs for redelivery, storage, labour and transport.
Where we install or set up the product, we will take reasonable care. We are not responsible for pre-existing damage, weak flooring, fragile surfaces, unsuitable electrical sockets, access restrictions, or damage caused by circumstances outside our reasonable control.
13. Removal or disposal of old furniture
Where we agree to remove or dispose of old furniture, this must be confirmed before delivery.
Old furniture must be safe, hygienic, reasonably accessible, and ready for removal. We may refuse to remove items that are unsafe, heavily soiled, infested, contaminated, structurally unsound, too large to remove safely, or blocked by access restrictions.
Unless agreed otherwise, we do not dismantle large items such as beds, sofas or fitted furniture.
Once old furniture has been collected for disposal, recycling or donation, it cannot be returned, reclaimed or stored. Collection of your old riser recliner, where agreed, is included in the price and there is no discount or voucher attached.
14. Risk and ownership
Risk in the goods passes to you once the goods have been delivered to your property or collected by you.
Ownership of the goods remains with Comfort Workshop / David Carter Design until we have received payment in full.
You should take reasonable care of the goods once they are delivered.
15. Guarantees
Our products may be supplied with a Comfort Workshop guarantee. The guarantee period and cover will be confirmed separately on your order paperwork, warranty document, brochure or website.
Unless stated otherwise, our guarantee covers defects in materials or workmanship arising from normal domestic use.
The guarantee does not cover:
- normal wear and tear;
- accidental damage;
- misuse, neglect or abuse;
- damage caused by pets, smoke, fire, water, sunlight, staining, bodily fluids or contamination;
- incorrect cleaning or unsuitable cleaning products;
- failure to follow care instructions;
- unauthorised repairs, alterations or dismantling;
- commercial or institutional use unless agreed in writing;
- changes in your personal circumstances, medical needs, body shape, posture or comfort preference after delivery;
- fabric shading, natural fabric variation, cushion settlement, or normal softening of foams over time.
If a valid guarantee claim is accepted, we may repair the product, replace the affected part, supply a replacement product, or offer another appropriate remedy.
Your guarantee is in addition to your statutory rights.
16. Faulty, damaged or incorrect goods
You should inspect the goods as soon as reasonably possible after delivery.
If you believe the goods are faulty, damaged or incorrect, you must contact us as soon as possible and provide details, photographs where helpful, and your order information.
If the goods are faulty, damaged or incorrectly supplied, we will deal with the matter in accordance with your legal rights. This may include repair, replacement, price reduction, refund, or another appropriate remedy depending on the circumstances.
Please do not attempt to repair, alter or dismantle the goods without speaking to us first, as this may affect your guarantee or legal remedy.
17. Care and safe use
You must use the product safely and in accordance with any instructions provided.
Riser recliner chairs contain moving parts and should be operated with care. Children, pets and vulnerable people should be kept clear of moving mechanisms, footrests, scissor actions and castors.
You must not sit or stand on the footrest, arms or back of the chair.
You must not exceed any stated weight limit.
Electrical products should be plugged into a suitable socket and kept away from water, damage, trapped cables and trip hazards. If you notice unusual noise, smell, movement, damage or electrical issues, stop using the product and contact us.
18. Medical, comfort and suitability
We take care to help customers choose suitable seating based on the information available at the time.
However, comfort is personal and can be affected by changes in health, posture, weight, medication, injury, swelling, mobility or personal preference.
Unless specifically stated in writing, we do not guarantee that a product will provide a particular medical benefit, cure or prevent a medical condition, remove pain, improve circulation, prevent pressure sores, reduce swelling, or replace clinical care.
Where pressure care, postural support, hoisting, transfers, tissue viability or complex mobility needs are involved, advice should be taken from a suitably qualified healthcare professional.
19. Delays outside our control
We are not responsible for delays caused by events outside our reasonable control. This may include supplier delays, fabric shortages, component shortages, transport issues, staff illness, severe weather, accidents, fire, flood, strikes, power failure, machinery breakdown, or other circumstances beyond our control.
If a significant delay occurs, we will contact you as soon as reasonably possible and try to reduce the delay.
20. Our liability
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory rights.
We are not liable for losses that are not reasonably foreseeable, loss of profit, loss of business, loss of opportunity, or indirect losses.
We are not responsible for damage caused by misuse, unsuitable access, failure to follow instructions, unauthorised changes, or circumstances outside our reasonable control.
